We currently have an exciting opportunity for a Commercial Director, Vogtle Units 3&4.  In this position, a Commercial Director can expect to be responsible for the following:
  • Manage and direct the commercial management team in prime contract (EPC) administration and compliance management
  • Manage and direct the subcontract management administrative team commercial issues and dispute support.
  • Act as the commercial lead and interface with the Owner.
  • Provide the construction subcontract commercial administration and interface with the WEC construction subcontract manager for resolving commercial issues.  . 
  • Manage the invoicing process and payment milestone management.
  • Establish signed EPC Contract and Amendments for the project and provide controlled copies and training on the documents to the appropriate Project and WEC/WECTEC staff.
  • Establish necessary control of recommended/proposed changes to the EPC Contract, manage the proposal/offer development, LOA preparation, the process for their negotiation/approval and change order execution.
  • Prepare internal governance documents and associated PowerPoint presentations as required.
  • Assist in preparation of project claims and prepare supportive project strategies for their submittal and timely resolution with the Owner and evaluate and recommend strategies to resolve claims from the Owner that are supportive of WEC and subcontractors.  Provide commercial support for dispute resolution (DRB)
  • Responsible for commercial issue resolution and the management of the division of responsibility (DOR) between the parties
  • Establish process upon which correspondence and technical documents and decisions that could impact the EPC Contract are reviewed and managed to ensure most efficient and correct disposition for WEC, including the review and approval of all commercial correspondence.
  • Establish appropriate record/file of contracts and agreement documents.
  • Make recommendations to the Project Director concerning Project implementation and the resolution of any disputes concerning implementation.
  • Provide interpretation and support to Project Director on project decisions regarding limits of authority.
  • Submit to the Contractors, or internally, any Owner proposed amendments to the EPC contract and coordinate necessary approvals.
  • Insurance manage compliance reviews, reporting and assist in preparation of claims under any insurance policies.
  • Ensure communication across projects to as appropriate to address common commercial issues and sharing of lessons learned
  • Manage and ensure Davis Bacon compliance

Job Requirements
The successful candidate for this position will possess the following:   
  • 10 -15 years progressive experience in commercial contract management for large engineering, procurement and construction projects
  • B.A. or B.S. degree in Engineering, Business or related discipline required; JD degree preferred; MBA desirable.
  • Highly skilled in area of communications, both written and oral, including ability to comprehend and negotiate complex issues. Previous management experience required.
